Terms and Conditions for Trainings and Workshops

The following rules, rights, and conditions help both my clients and me to ensure that trainings and workshops run smoothly. They describe the framework that applies and create transparency and reliability.

1. Contracting Parties

Clients of my trainings are individuals who book participation themselves, as well as companies that book participation on behalf of their employees.

2. Scope

  1. These Terms and Conditions for public trainings and workshops apply to any registration for one of my publicly listed events, e.g. on prokanban.org.
  2. Registration can take place via my website, via prokanban.org, or by e-mail. This includes registrations carried out by you personally as well as those made by me on your request or by third parties on your behalf.
  3. These Terms and Conditions apply in full, even if I do not enforce them strictly in every instance.
  4. By entering into a contract, you accept these Terms and Conditions for public trainings and workshops.

3. Content and Copyright

  1. The content of the training is specified in the course description on the platforms mentioned above.
  2. Course materials are protected by copyright and may not be shared or reproduced, in whole or in part, without my explicit written consent.
  3. Recording of my trainings (video, audio, or photography) is not permitted. This is expressly emphasized with reference to copyright, house rights, and general personal rights, including the right to one’s own image and spoken word.
  4. Participant registration data (first name, last name, email) for official trainings from prokanban.org will be forwarded to prokanban.org in order to send the certification exam invitation.
  5. Registration data will also be used to send follow-up information and, if applicable, course materials after the training.
  6. Registration data will never be sold or otherwise used beyond what is described here.

4. Registration and Contract

  1. Courses published on the platforms mentioned above or in other media do not yet constitute a binding offer.
  2. A binding offer to participate only arises through a written registration via the platforms mentioned above or by e-mail.
  3. The contract becomes legally effective upon written confirmation of registration by e-mail.

5. Payment and Invoice

  1. All prices are exempt from VAT according to § 6 Abs. 1 Z 27 UStG (Austrian VAT law). No additional tax applies.
  2. The participation fee must be paid no later than one week before the start of the training. Payment can be made via the available platforms using credit card, debit card, or digital wallets. If registration takes place via e-mail, an invoice will be sent by e-mail allowing payment by bank transfer. In all cases, participants will receive an invoice for their payment.

6. Cancellation and Non-Participation

  1. Non-participation in a training must be communicated in writing and is only valid once confirmed in writing.
  2. For cancellations up to two weeks before the start of the training, 20% of the ticket price will be charged..
  3. For later cancellations or non-participation, the full participation fee is due.

7. Cancellation by the Organizer

  1. Trainings may be cancelled by the organizer up to four weeks before the scheduled start date.
  2. After this period, trainings may only be cancelled due to illness or force majeure.
  3. In the event of cancellation, the participation fee already paid will be refunded immediately.

8. Final provisions

  1. Austrian law applies. Should individual provisions of these Terms and Conditions be or become invalid, the contract shall remain valid in all other respects. The invalid provision shall be replaced by a valid one that comes closest to the intended economic purpose.
  2. The place of jurisdiction for all disputes is Vienna, provided the contracting party is an entrepreneur. If you have no place of residence in Austria or another EU member state, Vienna shall also be the place of jurisdiction. In all other cases, the statutory place of jurisdiction for consumers applies.
